The Blue Estate employs procedures for dispute resolution that do not require lawyers, judges or courts, and that are less adversarial, less costly, and more efficient.
Every individual, company or legal entity domiciled on the Blue Estate, agrees in advance that any dispute related to other individuals, companies or legal entities on the Blue Estate, has to proceed through 'The Blue Estate Dispute Resolution Forum'.
The Blue Estate Dispute Resolution Forum consists of the following mandatory steps, that have become a critical part of many legal systems worldwide. To date many litigants would prefer to reach their own resolution of a dispute rather than allowing a jury to make the final decision.
STEP 1: SETTLEMENT CONFERENCE
The Blue Estate requires all parties to participate in a settlement conference before they can take a case to arbitration. A Mediator will preside over the settlement conference and listen to the arguments of each side. Mediators will facilitate the negotiations and can make suggestions, but they cannot force the parties to settle against their will. If the parties reach a settlement, they will draft and sign a legally binding settlement agreement. If the parties cannot reach a settlement, the case will continue toward step 2: Arbitration.
Step 2: ARBITRATION
On the Blue Estate a panel of arbitrators will decide the outcome of each case. The parties will have to call witnesses, cross-examine opposing witnesses, and present documents and other evidence to support their position. A decision made in arbitration by the Blue Estates arbitration panel is legally binding on the parties, unless both parties agree that the arbitration will be non-binding. Arbitration cases will not become part of a public record.
Final Step: INDEMNISATION & PENALTIES
After the dispute is resolved, either by a successful settlement conference or by the arbitration, the indemnisation, reparation and/or penalties have to be made/payed.
In case of severe or repeated offense, the one found lawfully guilty might be temporally or permanently prohibited entry to the Blue Estates premises and facilities. The Blue Estate Group reserves its right to appear as main or joint plaintiff, should the damage exceed personal / individual characteristics, and could be interpreted as damaging to our community, our values or safety.
We want to be a community with the greatest possible degree of personal and economic freedom. Nevertheless there are some activities and items that are strictly prohibited on the Blue Estate to ensure a peaceful coexistence. We'll employ a 'Zero Tolerance' policy with offenses related to the areas mentioned below.
